Tour/services requests will not be accepted unless the below terms and conditions are agreed to

ARTVIVA – THE ORIGINAL AND BEST WALKING TOURS TERMS AND CONDITIONS

Artviva, otherwise known as The Original and Best Walking Tours, sets forth the following terms and conditions:
Artviva, also known as The Original and Best Walking Tours, hereafter referred to as Artviva, provides a variety of travel services, including but not limited to, guided tours, event and wedding services, transfers, and bespoke, custom, consultation, trip management, planning, concierge and last-minute booking services and accommodation. These Terms and Conditions set out the basis on which these services are provided.

By booking any services with Artviva, you are automatically agreeing to these terms and conditions. Please carefully review all of the terms and conditions prior to booking any services. Your use of our services indicates your acceptance of these terms and conditions.

GENERAL CONDITIONS:
Artviva otherwise known as The Original & Best Walking Tours, is a licensed Tour Operator based in Florence Italy, lic. no. 516411. Artviva and its agents are not liable for any loss or damage of possessions, personal injury or death. The company is not responsible for any injury, loss, delay, inconvenience caused by force majeure or other events such as strikes, wars, acts of terrorism, floods, severe weather, acts of God, traffic delays, or any other circumstances which are beyond our control. We reserve the right to modify and integrate these terms and conditions at our discretion.

OUR RESPONSIBILITY:
Artviva agrees to provide services on the understanding that you and the persons you reserve for are fit and healthy enough to complete the tour or service and accept that in any tour or service some risk may be involved. When you book a tour or other service with us, you acknowledge and accept that Artviva, its agents and suppliers, in making arrangements for hotels, tours, transportation or any service in connection with the itineraries of individual tour members shall not be liable for injury, damage, loss, accident, delay or irregularity, liability or expense to person or property due to act of default by any hotel, carrier or other company or person providing services included in the tours and transfers or museum or other bookings. Artviva, its agents and suppliers accept no responsibility for any entry delays, strikes, sickness, pilferage, labour disputes, machinery breakdown, government restraints, acts of war and terrorism, weather conditions, defect in any vehicle of transportation or for any misadventure or casualty or any other causes beyond their control. We reserve the right to cancel, change or substitute any service and to decline to accept any tour members at any time for any reason including, without limitation, insufficient number of participants. All documents/vouchers are issued subject to the terms and conditions specified by Artviva, its agents and suppliers.

TRAVEL INSURANCE:
We strongly recommend travel insurance is arranged for cancellations due to unforeseen circumstances or those beyond control. We recommend medical and personal insurance to cover medical expenses and/or loss of baggage, cash or personal belongings, or for any unexpected occurrences.

TYPES OF SERVICES:
Artviva offers various services, including but not limited to:
1. Semi-Private Tours
2. Private Tours
3. Virtual Tours
4. Bespoke Services
5. Consultations
6. Event Planning
7. Transfers
8. Accommodation
In providing these services, Artviva incur non-refundable costs, including staff time, expertise, museum tickets, reservations, etc. All services are non-refundable except for Semi-Private tours where non-refundable costs may be incurred.

TOURS & SERVICES:
All group tours are conducted in English only unless otherwise noted. By reserving any tour or service, it is agreed that all participants have read the tour description and have agreed to all the terms and conditions, as well as any extra requirements that may appear with the individual tour or product descriptions, such as minimum numbers required to run tours, dress codes, weather limitations, child suitability, etcetera.

ACCOMMODATION: No refunds. Full payment on booking.

ACCOMMODATION DAMAGE:
We will charge your credit card for any damage or extra costs incurred or made during your stay in any accommodations we provide or booked through us.

CONFIRMATIONS:
Full payment must be received to confirm tours. We may request a bank transfer for payments over 1000 euro. We do not take responsibility for non-receipt of emails. Please ensure your spam filter is not blocking emails from [email protected] or [email protected]. An automatic confirmation is sent upon booking online. If you do not receive an email confirmation, please check your spam folder or email us at [email protected] or phone our company on +39 3296132730. For weather-dependent tours, please also contact us the day prior via email and be sure to provide correct local contact details in case we need to reach you.

CANCELLATIONS BY CLIENTS:
Cancellations must be made in writing to [email protected].
All services are non-refundable except for Semi Private Tours where the cancelation is made before 7 days ahead of the tour. In case of no-show or cancellation before the service, no refund will be provided. We will not be responsible for partial shows during the tour including leaving early on a service. The only exception to this cancelation policy is for Semi Private Tours.

CANCELLATIONS BY ARTVIVA:
Cancellations by Artviva, due to force majeure or other unforeseen events such as strikes, wars, acts of terrorism, floods, severe weather, acts of God, traffic delays, or any other circumstances beyond our control will be managed on a case-by-case basis. While Artviva will strive to provide a refund, it cannot guarantee a full refund for all costs that are non-refundable to Artviva.

CHANGE & AVAILABILITY:
All tours, services and prices are subject to change and availability. Artviva reserves the right to modify and integrate all inclusions and services without prior notice. This may be due to but not limited to closure of included locations, traffic, weather, strikes and protests, restoration or construction works and others.

REBOOKING:
If you wish to reschedule a tour or service, this may be subject to availability and a fee. All rescheduling requests must be sent to [email protected].

LAST MINUTE

Any requests received within two weeks of the proposed tour/booking/service/accommodation date will be charged a fee from 200 Euro to 500 Euro as a last minute booking additional fee which is non refundable.

NUMBER OF PARTICIPANTS:
If a tour is not reaching the minimum number of participants as stated on our website, we reserve the right to cancel the tour. The customer will be fully refunded or offered an alternative tour or date.

ARRIVAL TIMES:
We recommend arriving 15 minutes before the departure time for all tours and services. We are unable to delay departure due to late arrivals and we reserve the right to cancel your reservation if you do not arrive at the allocated meeting point for the stated departure time. For late arrivals, it remains at our discretion if rebooking is available, rebooking charges may be incurred. Refunds cannot be provided for non-arrivals. Artviva is not responsible for late arrivals caused by transport delays or strikes.

DRESS CODE:
Knees and shoulders must be covered for entry into churches. We recommend bringing a shawl or scarf for coverage if needed. It is also recommended that you wear comfortable shoes for tours. We recommend comfortable walking shoes, with closed-toe footwear required for bike tours and any others involving walking on mixed terrain. Refunds cannot be granted if you cannot join or complete a tour for lack of correct attire.

CONDUCT OF PARTICIPANTS:
Disruptive behavior, intoxication or use of unauthorized illegal substances, inappropriate conduct, or rudeness or aggression towards Artviva staff or affiliates or agents is strictly prohibited. Artviva reserves the right to refuse entry, to ask anyone engaging in such behavior to leave, or to eject any participant engaging in such behavior, without refund or recourse.

PARTICIPATION LIABILITY WAIVER:
By purchasing or participating in a service and/or tour, you agree to these terms and conditions and understand its contents, and you accept responsibility for your participation and release Artviva and its agents from any liability that may arise from your participation in the tour or service.

MUSEUM ENTRY:
Museum entry will be expedited by a pre-reserved entry time, and we do not anticipate waiting in the general admission line. However, all visitors must pass through museum security. During peak travel months, there may be an unavoidable wait during security screening.

SOUND SYSTEMS:
If a sound system is provided for a tour, it must be returned in good condition or a fee of up to 150 euros per headset will be charged for the replacement of any items damaged or lost.

PERSONAL BELONGINGS:
Large bags and backpacks are not permitted in museums and there are often no convenient storage facilities. Storage facilities are available at most train stations or your hotel. Some museums have a place to check in bags, but not all. It is up to you to inform your guide if you need a place to leave an oversized bag in the museum entry cloak room.

PRIVACY:
In accordance with the European Regulation 2016/679 (GDPR), Artviva processes your personal data under principles of correctness, lawfulness, transparency, and protection of your privacy. Your data are processed for the entire duration of the relationship contract and also subsequently, for contractual requirements and related fulfillment of legal obligations and taxation, and for effective management of financial and commercial relationships. Your data will not be disseminated to third parties by us. You can exercise your rights by writing to the Data Controller with an email to: [email protected]. ALL RIGHTS RESERVED:
All rights reserved by Artviva. Any reporting or recording (video or audio) of tours and/or services must have prior written permission from the management. All content provided on our websites, marketing and publicity including but not limited to graphics, images, logos and text, and the arrangement thereof is the copyright of Artviva and is protected by applicable international laws. Any use (including display, distribution, modification, republication, reproduction, or transmission of the content) is strictly prohibited. Services provided to bona fide clients only.

DISCLAIMER:
Artviva makes no claim or representation, and accepts no responsibility, regarding the quality, nature, or reliability of the sites accessible by hyperlinks from our website, or sites linking to our website. Whilst we make every effort to be accurate, Artviva assumes no responsibility or liability for the representations contained on our brochure or website or any other site that offer our tours/services.

NON-SOLICITATION
Non-Solicitation of Clients/Partners/Suppliers/Vendors/Employees/Ex-Employees.
Client and or Partner acknowledges and agrees that he shall not, directly or indirectly, solicit, take away or divert, or attempt to solicit, take away or divert, the business or patronage of any Client/Partner/Employee/Employee/Supplier or Customer of the TOBWT with the intention or for the purpose of providing services that compete with, undercut or avoid the services provided by the Artviva.
If Partner/Client needs to contact a Supplier, Vendor-Partner/Client shall request through ArtViva via email, unless agreed to otherwise by Artviva.

MEDIA MATERIAL USAGE RIGHTS

In the context of tours, events, or activities organised by Artviva , Artviva may capture or solicit images, videos, reviews, and other media content (“Media Material”). This may include but is not limited to photographs or video footage taken by our contracted photographers or videographers, as well as video reviews provided by clients.

By participating in these activities, you grant the Artviva a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform the Media Material in which you appear or contribute.

This license extends to promotional, marketing, and publicity purposes, including but not limited to display on the Artviva social media channels, online and offline promotional materials, and any other publicity efforts undertaken by Artviva.

Please note that by agreeing to these terms, you waive any rights of privacy or publicity you may have in connection with the Media Material. You acknowledge that Artviva has the right to use such Media Material without providing further notice to you or obtaining additional consents.

Your agreement to this Media Material Usage Rights clause does not obligate the Artviva to use any specific Media Material, and the Company reserves the right, in its sole discretion, to decide whether and how to use any such Media Material.

DISPUTES GOVERNED BY ITALIAN COURTS:
Contracts with Artviva are governed by Italian law and in case of dispute jurisdiction is conferred on Italian courts. In the case of a dispute, notice must be provided in writing within seven days of the date of service provided.
